The subject property is located at 110 E. Lake Street. The property is zoned B-1C, Central Business Core District. The applicant is requesting a license to operate a sidewalk café in the public right of way in front of their building on the south side of Lake Street.
The Licensee must maintain an unobstructed width of 60 inches of sidewalk adjacent to the street for use by the general public and for ensuring accessibility by all persons traveling on the sidewalk.
The entire outdoor area utilized for service and consumption of food and beverages has to be visible from the restaurant establishment.
Service of food and beverages in the sidewalk café shall be limited to persons seated at tables in the licensed sidewalk café area. Food service shall be required to be available at all times when the sidewalk café is open.
Each license holder shall be responsible for policing the area of the sidewalk café to ensure that the sidewalk is clean. All debris and unused food in the sidewalk café area shall be removed by the license holder before the close of business each day. All spills, food, litter, or any other item on the sidewalk that is associated with the service or consumption of food and beverages shall be cleaned or removed as soon as practicably possible to minimize slip or fall hazards on the public sidewalk that is located inside the sidewalk café, as well as the public sidewalk adjacent to the sidewalk café.
The Council has solicited testimony from the public regarding any evidence and testimony related to the sidewalk café and the Council will consider all of the available factual evidence concerning the requested action as it relates to the previously stated requirements.
